No set time for re-appointment

My Dear Prime Minister,

I thank you for your letter of 13 December, 2000. There is no established practice regarding the time after a general election within which the appointment or re-appointment of a Prime Minister takes place. Records in this Office show that it is only after a copy of a letter from the chairman of the Elections and Boundaries Commission to the Honourable Speaker of the House of Representatives conveying the certified results of the General Election was received from the Chairman of the Elections and Boundaries Commission the appointment was made.

Records also show that the time of the receipt of this letter varied significantly on past occasions.

I shall be pleased to communicate with you further when it is appropriate to do so.

IN view of the misinformation in the public domain concerning the functions of the President after a Parliamentary Election, the Office of the President issues the following statement:

“It is only after receipt of the certified results of the elections, the President can make a decision based on those results. An authoritative report of those results can be made only by the Elections and Boundaries Commission. While the Constitution places on the President the obligation to act, the President can only do so after receipt and due consideration of the certified results of the elections.

“The procedure which has been observed is that the chairman of the Elections and Boundaries Commission writes to the Speaker of the House of Representatives appending to his letter the certified results of the Elections. The chairman of the Elections and Boundaries Commission also writes to the President attaching a copy of his letter to the Speaker together with the certified results of the Elections. This is the procedure which has been followed after previous general elections, as appears in documentation at the Office of the President.
